Sample letter of wishes

as Trustees of
the _______________ Trust.
Dear Sirs,
You are Trustees of the Settlement dated the________day of________Two Thousand and________created by me, which sets out the terms upon which you are to hold certain assets received by you from time to time.
The Settlement gives you wide discretionary powers over capital and income including power to distribute either capital or income within a very long period amongst a class of beneficiaries. You also have power to add persons to that class of beneficiaries from time to time.
Whilst I am aware that these directions and powers are under your absolute control, you may find it helpful if I express in this letter my considered wishes as to how you should exercise them.
I would like you to consult myself/ __________at regular intervals during my/their lifetime, or any person nominated by myself/them, and make such distributions of income and capital and invest the funds in such manner as I/they may request you, and add to the class of beneficiaries under the Settlement such persons as I/they may from time to time request.
At the date of the expiration of the Trust period, I would like you to hold the Trust Fund upon Trust for the following persons or bodies, as the ultimate beneficiaries of the Settlement:-
Furthermore, please be aware of economic, social, political, legal, military or fiscal changes and influences which might affect the Trust or its potential beneficiaries and take such action as you deem necessary or prudent, including if necessary, changing the terms of the Trust or varying from my wishes as mentioned above.
